The legal struggle between Activision and Brutal Legend developer Double Fine has ended with an out-of-court settlement.
In June, Activision filed a lawsuit to stop the release of Brutal Legend this October by rival publisher Electronic Arts. The game publisher claimed that they still owned the rights to the title. Double Fine countersued, stating that Activision had terminated the publishing contract after they failed to absorb the game into their Guitar Hero franchise. The judge scheduled to hear the case this morning had previously let slip that he was unlikely to side with Activision on the matter. The hearing was later canceled when the two sides came to an undisclosed settlement.
This is good news for EA, who have dumped a sizable amount of cash into marketing the game. The love child of Jack Black and developer Tim Shafer, Brutal Legend stars Eddie Rigs, a roadie for a metal band who slays demons with his magic-imbued V-Factor guitar. The game is scheduled for release October 13, on both PS3 and Xbox 360.
